爱船网:贵司目前承保的船舶中是否有属于俄罗斯投资背景的船舶?贵司目前承保的船舶中,预计有多少艘船舶会进入俄罗斯水域?

Whether any vessels in the background of Russia's investments are insured by your company?How many ships insured by your company are expected to enter the Russian waters?

Freddie Tan:这些问题很难。Raets Marine承保全球航区的船舶。除其他类型的索赔之外,Raets Marine每年处理成千上万有关船东责任和承租人责任的索赔。这些船舶也去俄罗斯的东海岸和西海岸,经常去的港口例如圣彼得堡、诺沃西比尔斯克和海参崴。

The questions were quite difficult to answer.At Raets Marine we insure vessels that trade globally and we deal with tens of thousands of declarations on a yearly basis for, amongst others, ship-owner’s Liability and Charterer’s Liability. These vessels also call Russia’s East as well as West coast whereby St Petersburg, Novorossiysk and Vlapostok are amongst the Russian ports most frequently called at.

爱船网:过去贵司承保的船舶中,总共在俄罗斯发生了大约多少起案件?其中较大的案件有哪些,看是否简单介绍一下?目前在俄罗斯如果发生了货损或者油污等P&I方面的案件,他们的一般的处理程序如何?

Refer to the loss record, how many cases happened in Russia? Would you briefly introduce some typical and large cases?If cargo damage or oil pollution happened in Russia, how do you deal with it?

Freddie Tan:2014年截止目前RAETS已经在俄罗斯港口收到23个索赔通知,但这些索赔并没有让RAETS更多地接触到客户。在俄罗斯港口的索赔也没有什么特殊性,但值得注意的是俄罗斯在冬季有冰封的港口,谨慎的船东和承租人在签订冬季前往俄罗斯港口的租约之前应该要注意到这一点。另外,在签约之前还应该注意某些遭到贸易和金融制裁的俄罗斯公司。

In the year 2014, we so far had 23 claim notifications relating to Russian ports, none of them resulted in a major exposure to our Clients. There are no particular types of claim that stick out as being ‘typical’ for Russia although one should always bear in mind that Russia has icebound ports in wintertime which is something that prudent Owners and Charterers have to bear in mind in the pre-contractual stage when trading to Russian waters in wintertime. Besides, there are still some trade and financial sanctions applicable against certain Russian Companies that is also something to bear in mind in a pre-contracting stage.

爱船网:在海事处理方面,俄罗斯他们目前适用的法律是哪些?

Which rules and laws are applicable to marine cases happened in Russia?

Freddie Tan:有关侵权行为索赔例如碰撞或污染发生在俄罗斯港口,普遍适用当地法律,基于当地法院管辖。像货损案件,通常适用并入运输合同的规则或法律;而船员这类型索赔,通常适用船员合同中当事人双方约定的任何法律和管辖权。

Please do bear in mind that in case of tortious claims (such as for example collisions or pollution claims) local law is commonly applicable whereby Clients place themselves within the jurisdiction of the local Courts and the local system. For other types of claims such as cargo claims, damage to hull claims, crew claims etc, usually the law which has been incorporated in the contract of carriage or the crew contract will apply which can naturally be any law and jurisdiction that parties will agree to.

爱船网:Raets Marine目前在俄罗斯的通代有哪些?如果在俄罗斯出险,Raets的保函是否可用?如果不被接受Raets如何采取下一步的程序?

Do you have some correspondents in Russia? Whether Russians can accept LOU issued by your company? If not, please kindly advise youralternative ways or next steps for releasing the vessel.

Freddie Tan:RAETS在鹿特丹和新加坡都有专业的索赔处理机构,在紧急情况下,他们可以7天24小时为客户提供服务。并且,RAETS也有遍布全球的有资质的有关赔案处理的合作伙伴像通代、检验师和律师,自然包括俄罗斯的主要港口。RAETS担保信用评级为A,即AMLIN的标准普尔评级,全世界范围内通常都可以接受RAETS出具的担保。如果索赔方不接受RAETS出具的担保,大金额案件,RAETS会安排银行出具担保,小金额案件则尽量迅速与索赔方达成和解,以防被保险人船舶被扣。但这样操作的前提是船东必须已经付清所有到期保费及处理好免赔额以下自行承担的损失部分。

We have professional claim handling facilities in Rotterdam as well as Singapore who are at Client’s disposal 24/7 in case of emergency. Thereby, we also have a vast global network of qualified suppliers (correspondents, surveyors and lawyers) and naturally also in the major Russian ports. Our A-rated security (S&P’s rating of Amlin) is usually accepted all over the world. If the claimants are not willing to accept our LOU,we do put up Bank Guarantee for bigger cases or do quick settlements for smaller ones. Bearing in mind issuance of security is under discretion of Club, we would generally require our Assured to clear up his unpaid premiums and deductibles before we do above.
